These Terms of Service (“Terms”) constitute a legally binding agreement between Baba Meal Masters (“Company”, “We”, “Us”, “Our”) and any individual, staff member, restaurant, firm, client, or user (“User”, “Staff”, “Client”, “Restaurant”, “You”) who accesses, engages with, or uses our services, platform, or workforce.
By using our services, submitting any form, engaging staff, or accepting placement, you expressly agree to be bound by these Terms. If you do not agree, you must not use our services.
1. Nature of Services
Baba Meal Masters operates as a restaurant staffing, workforce management, recruitment, and service facilitation firm, including but not limited to:
- Recruitment and placement of restaurant staff
- Individual staff deployment (chefs, managers, waiters, etc.)
- Ongoing staff management services
- Restaurant operational support
- Job postings and applications
We act as a service provider and workforce manager, not merely an intermediary.
2. Legal Relationship
Staff provided through Baba Meal Masters remain under the operational management of the Company unless explicitly stated otherwise. Restaurants and clients do not acquire ownership or permanent employment rights over staff supplied by us. Nothing in these Terms creates a partnership, joint venture, or employer-employee relationship between the Client and the Company’s staff.
Staff Terms (Mandatory)
These terms apply to all staff working with or through Baba Meal Masters.
3. Notice Period (Strict)
Any staff member wishing to resign must provide a minimum notice period of fifteen (15) days. Failure to serve the notice period may result in forfeiture of pending salary or dues, blacklisting from future placements, or legal action for business loss or disruption.
4. Salary Acceptance & Non-Interference
Staff agree to work at the salary and role mutually agreed at the time of onboarding. Staff shall not raise objections, disputes, or claims regarding fees charged by Baba Meal Masters to restaurants or commission margins. All financial arrangements are strictly confidential.
5. Non-Solicitation & Non-Circumvention
If a staff member resigns, is terminated, leaves a placement, or is reassigned, they shall not work directly or indirectly with the same restaurant or client without written permission from Baba Meal Masters. This applies even if approached directly by the restaurant. Violation will result in immediate legal action for business loss and damages.
6. Misconduct & Termination
Baba Meal Masters reserves the right to remove staff immediately for misconduct, insubordination, absenteeism, or client complaints. No compensation is guaranteed in such cases.
Client / Restaurant Terms
These terms apply to restaurants, firms, and service-seeking clients.
7. Payment Obligations
All payments must be made on or before the due date. Full payment execution must be completed within fifteen (15) days from the invoice date. Delayed payments may attract service suspension, staff withdrawal, or legal recovery.
8. Advance Payment Requirement
From the first day of service commencement, 35% of the total agreed amount must be paid in advance. No staff deployment will occur without advance payment confirmation.
9. Package Plans & Installments
Package plans must be paid in two (2) installments within one (1) month. Failure to pay on time may result in immediate service suspension.
10. Staff Interaction Restriction
Clients shall not directly negotiate, influence, or contract with staff provided by Baba Meal Masters. All coordination must occur through the Company.
General Legal Protections
12. No Guarantee Clause
Baba Meal Masters does not guarantee continuous availability of any specific staff, job permanence, or specific business outcomes. Services are provided on a best-effort basis.
13. Limitation of Liability
Baba Meal Masters shall not be liable for indirect, incidental, or consequential damages. Our total liability shall not exceed the fees paid for the specific service in dispute.
16. Governing Law
These Terms shall be governed by the laws of India. All disputes shall be subject to the exclusive jurisdiction of courts in [Your City / State].
